Der BGH fällt eine richtungsweisende Entscheidung für Verwertungsgesellschaften in Deutschland: der GEMA obliegt demnach lediglich eine eingeschränkte Verpflichtung zum Abschluss eines Gesamtvertrages; eine Lizenzierungspflicht besteht zudem lediglich gegenüber dem tatsächlichen Nutzer der Rechte (Urt. v. 14.10.2010, Az. The legal position expressed by Becker Büttner Held has been fully confirmed by the German Federal Court of Justice (BGH): A fee collected by GEMA from the rights user was not too low. In applying their own tariffs, GEMA must be given discretionary powers if thus inadequate fees could be avoided in individual cases. Individual members of GEMA acting as trustee for third-party copyrights must not be involved in negotiations with the individual rights user.

In January 2011, the Bundeskartellamt (German Federal Cartel Office, BKartA) published the findings of its sector inquiry into „Electricity Production and Wholesale”. These were remarkable, but did not quite come up to the expectations of the market. In today’s issue of the German magazine DER SPIEGEL a legal report prepared by Becker Büttner Held (BBH) for the parliamentary group Bündnis 90/DIE GRÜNEN was mentioned. Transparency in the electricity generation market is elementary for all market participants. A market, where just four companies hold a good 80% share of capacities, must be subjected to qualified monitoring.
