The liberalisation following the new Energy Act has resulted in a lot of demand for legal support concerning airports and industrial sites. As long as the company concerned is not privileged with a so-called area network, the company has to comply with a lot of obligations, ranging from the generation, supply and distribution to the network operation and thereby including all the stages of value creation. Other issues of importance for operators of industrial sites and airports are the unbundling requirements of the future Energy Act, the restructuring according to the new obligations of the future Energy Act as well as the preparation for an active regulation management. Moreover, professional advise is needed when improving the conditions of buying energy, as well as the optimisation of electricity taxes according to the Electricity Tax Act (Stromsteuergesetz). Finally, BBH is helping its clients in the context of privatisation and outsourcing projects of airports and industrial sites, where a large range of questions specific for the economic sector needs to be covered next to the energy-related structure of the company: The relevant questions range from structural advise (corporate and tax law), procurement questions to sectorial regulative requirements as e.g. air traffic law. Contact persons in this area are Dr. Martin Riedel (Berlin) and Dr. Christian Jung (Cologne). |
