There is hardly any other area of law which has undergone such drastic changes like the law of public procurement, which regulates the public tendering. The requirements the public sector, including public companies, is facing have been increased immensely in particular by the legislation of the European Court of Justice.
We give legal advice and accompany our clients of the public sector in carrying out procurement procedures, e.g. in the areas of power plant construction, project development and Public Private Partnerships (PPP). Often already the question if there is an obligation to tender or how this tender has to be done requires an exact legal examination. This especially refers to restructuring of public companies, the foundation and assignment of communal companies and so-called service concessions. BBH also represents contracting entities and tenderers in procurement review procedures and/or complaint procedures.
