There is hardly any other area of law which has undergone such fundamental changes as the law of public procurement (i.e. the regulation of public tendering). Requirements imposed on the public sector and public companies have increased dramatically, especially due to the jurisprudence of the European Court of Justice. We provide legal advice and supervise our clients in the public sector by carrying out procurement procedures, e.g. in the areas of power plant construction, project development and Public Private Partnerships (PPP). Often the question arises as to whether there is an obligation to tender and how such tender is made. These questions require an exact legal assessment. This is especially the case in relation to the restructuring of public companies, the foundation and assignment of communal companies and so-called service concessions.
