Flood Control Act II: BBH partner Dr Miriam Vollmer appointed as expert in Bundestag procedure

The Act to further improve preventive flood control and to simplify flood protection procedures (Gesetz zur weiteren Verbesserung des Hochwasserschutzes und zur Vereinfachung von Verfahren des Hochwasserschutzes) – also known as the Flood Control Act II (Hochwasserschutzgesetz II) is intended to facilitate the planning and approval procedures for flood control measures. On 20/03/2017, a selected group of experts – one of them being BBH partner and lawyer Dr Miriam Vollmer – will discuss whether the bill drafted by the German government goes far enough. Within the framework of this public hearing held by the Bundestag Committee on the Environment, the experts will also examine how the objections to the bill raised by the Bundesrat are to be assessed.

The draft version of the Flood Control Act II principally provides for amendments to the Federal Water Act (Wasserhaushaltsgesetz – WHG), the Federal Nature Conservation Act (Bundesnaturschutzgesetz – BNatSchG), the Federal Building Code (Baugesetzbuch – BauGB) and the Code of Administrative Court Procedure (Verwaltungsgerichtsordnung – VwGO). Among others, specific protective measures shall be possible in “flood risk areas” and “areas where flooding is caused by surface water runoff” and recourse to the courts shall be limited to two instances. The public hearing to be held by the Committee on the Environment will assist in determining the specific need for improvement of the draft bill. Being one of the seven appointed experts, Dr Miriam Vollmer will contribute her long-standing experience in environmental and planning law. As a specialist lawyer for administrative law, she advises clients, among others, on immission control law and emissions trading.
